Criminal business law

We often hear or read that criminal law is gaining ever more traction over our society, and that it is increasingly punishing behaviour which previously would simply have been a matter for the perpetrator’s civil liability.

This perception is far from being a received idea, with criminal law constantly extending its reach, in particular when it comes to the economic and business sphere.

This means that a business’s managers, shareholders or even employees need to have a sound understanding of the risks associated with the fact that they and/or their company may be held criminally liable.

Derriennic Associates is there to offer them its advice, its knowledge and its expertise in criminal law as it applies to the world of business, whether it be a question of seeking the manager’s criminal liability, breaches relating to health and safety rules within a business, loss-making sales or illicit loaning out of staff, financial and economic offences affecting the life of companies (abuse of trust, embezzlement, misappropriation of corporate assets, bankruptcy, etc.), or the consequences of an accident occurring within a company (homicide or involuntary assault, the offence of causing danger to life, etc.).

In addition to the advice issued and the deeds which we can help to draw up to enable the head of a business to transfer some of the criminal risk (delegation of power), we will assist you and represent you right the way through all the stages of the criminal procedure (investigation, detention, police custody, indictment, interrogatories, court hearing, etc.).

Our lawyers are familiar with the substantive aspects and the procedure in criminal law, as well as the internal workings of a company and its operational constraints.

Derriennic Associates represents those accused as part of an investigation or a criminal procedure and the victims of offences/the civil party.
